The framework
Trinidad and Tobago has enacted the Data Protection Act 2011 (partially proclaimed), but the regime is not yet fully operative.
For media planning that means an opt-in posture, with consent capture built before campaigns launch.
Key instruments
Data Protection Act 2011 (partially proclaimed)
The 2011 Act has sat partially proclaimed for over a decade, with its administrative provisions live and its substantive obligations still waiting. Full proclamation is perennially promised.
Marketing and advertising
Consent-first in the unproclaimed parts; only general provisions are in force. Treat the consent note above as the planning rule; the penalty line below is what mispricing it costs.
Cross-border transfers
The Act's transfer provisions are not yet operative. In practice, the binding transfer rules for most international campaigns touching this market come from the origin jurisdiction of the data.
Enforcement and penalties
Penalties for the core duties are not yet operative.
